1. Acceptance of Terms
By downloading, installing, or using Opus ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is provided by OpusAI ("we", "us", "our").
2. Description of Service
Opus is an AI-powered audio equalizer for macOS that provides system-wide audio enhancement. The App processes audio locally on your device using CoreML and Apple's Accelerate framework. No audio data is transmitted to external servers.
3. Subscription & Billing
- Opus offers a 3-day free trial with full access to all features. No payment is required to start the trial.
- After the trial, a subscription is required: $4.99/month or $39.99/year.
- Subscriptions are managed through Apple's App Store and StoreKit 2. All billing is handled by Apple.
- You can cancel your subscription at any time through System Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period.
- Refund requests are handled by Apple per their refund policy.
4. System Requirements
Opus requires macOS Sonoma 14.2 or later running on Apple Silicon (M1, M2, M3, M4, or later). The App installs a CoreAudio HAL virtual driver for system-wide audio processing. You are responsible for ensuring your system meets these requirements.
5. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms and your active subscription.
6. Restrictions
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Distribute, sublicense, lease, or rent the App to third parties
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices or labels
- Use the App in any way that could damage, disable, or impair the App's functionality
7. Intellectual Property
The App, including its code, design, graphics, user interface, audio processing algorithms, machine learning models, and all related intellectual property, is owned by OpusAI and is protected by copyright, trademark, and other intellectual property laws.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Audio processing results may vary depending on your hardware, audio source, and configuration.
9. Limitation of Liability
To the maximum extent permitted by law, OpusAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to audio equipment, arising out of or in connection with your use of the App.
10. Updates
We may release updates to the App from time to time. Updates may include bug fixes, new features, or performance improvements. The App uses Sparkle for automatic update checks. You are encouraged to keep the App updated for the best experience and security.
11. Termination
We may terminate or suspend your access to the App at any time, with or without cause. Upon termination, your license to use the App ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer, and Limitation of Liability) shall survive.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
